Services Agreement and Terms

1. Services Provided

The Service Provider shall provide the User access to the web streaming service (the "Service") as described on the Service Provider's website.

2. ​Billing and Payment

2.1 Billing Cycle: The Service shall be billed on a monthly basis, commencing on the date of registration (the "Billing Cycle").

2.2 Payment: The User agrees to pay the subscription fee for the Service as follows: Payment starts at $250 for the first 6 TB of outgoing traffic For each additional TB of outgoing traffic beyond 6 TB, there will be an additional charge of $30 per TB. 

2.3 Payment shall be made through the designated payment method provided by the Service Provider.

3. Cancellation

3.1 Cancellation Notice: The User may cancel the Service at any time by providing a written notice of cancellation to the Service Provider at least 15 days before the desired cancellation date (the "Cancellation Notice").

3.2 Effective Cancellation Date: The Service shall remain active until the end of the current Billing Cycle following the receipt of the Cancellation Notice. The User shall be responsible for all fees for the Service until the effective cancellation date.

4. Connectivity

4.1 Customer Responsibilities: The User acknowledges that it is responsible for securing, paying for, and maintaining connectivity to the streaming services. This includes all related hardware, software, third-party services, and associated equipment and components.

5. Service Support and Availability

5.1 Basic Support: The Service Provider will provide basic support for the services at no additional charge.

5.2 Exclusions: The following are exceptions to the continuous availability of services: (i) Planned Downtime: The Service Provider will provide at least 24 hours' notice for any planned downtime. (ii) Unavailability Beyond Control: The Service Provider is not responsible for service unavailability caused by circumstances beyond its reasonable control, such as acts of nature, government actions, floods, fires, earthquakes, civil unrest, acts of terror, strikes or labor issues, internet service provider failures or delays, or denial of service attacks.

6. Disclaimers of Warranty and Limitation of Liability

6.1 Service Use: The Service Provider will not be liable for any injuries resulting from the use of the services or applications, including any errors, delays, interruptions in transmission, or service failures.

6.2 Limitation of Liability: The Service Provider, its affiliates, or agents shall not be liable to the User or any third party for any indirect, incidental, special, punitive, or consequential damages. This includes lost or imputed profits or revenues, lost data, or the cost of procuring substitute services resulting from service delays or interruptions, regardless of the cause or legal theory asserted.

6.3 Termination Rights for Misuse: The Service Provider reserves the right to immediately terminate the service in the event of misuse or unauthorized usage of the server or feeds. This includes, but is not limited to, activities such as software installation, network changes, altering Windows settings, or any other usage that deviates from the intended purpose of the service.

7. Intellectual Property

7.1 Ownership: The Service Provider retains all rights, title, and interest in the Service, including all intellectual property rights.

7.2 User Content: The User grants the Service Provider a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display any content provided by the User through the Service for the purpose of providing and promoting the Service.

8. Amendments

The Service Provider reserves the right to amend, modify, or update the terms of this Agreement at any time. The User will be notified of such changes, and continued use of the Service after the notification constitutes acceptance of the updated terms.

By using the Service, the User acknowledges that they have read and understood this Agreement and agree to be bound by its terms.
